Welcome to PromoLumi, a web-based service that allows users to generate promotional images and videos through AI ("Service"). By accessing or using PromoLumi, you agree to be bound by these Terms of Use ("Terms").

1. Acceptance of Terms

By using PromoLumi, you agree to comply with and be legally bound by these Terms. If you do not agree, you must not use our services.

2. Eligibility

You must be at least 13 years old to use PromoLumi. If you are under 18, you must have the permission of a parent or legal guardian.

3. Account Registration

To use the Service, you must create an account via our authentication provider, Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Usage Rights and Content Ownership

You retain ownership of your uploaded images and generated promotional images and videos. By using the Service, you grant PromoLumi a non-exclusive, royalty-free license to use, display, and process your uploaded content and generated assets solely for the purpose of providing and improving the Service. You are responsible for ensuring that you have the necessary rights to any content you upload to PromoLumi.

5. Prohibited Uses

You may not use PromoLumi to:

- Violate laws or third-party rights
- Upload harmful, abusive, or illegal content
- Reverse-engineer, interfere with, or abuse the system
- Generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.

6. Service Availability

We reserve the right to modify, pause, or discontinue any part of the Service at any time without prior notice.

7. Third-Party Services

We use third-party services including: Clerk (for authentication), Supabase (for database and storage), fal.ai (for AI generation), Google Analytics (for usage data). You agree to their respective terms of use and privacy policies when using PromoLumi.

8. Limitation of Liability

PromoLumi provides the Service "as is" without warranties. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or misuse the Service.

10. Changes to Terms

We may update these Terms periodically. Continued use of the Service indicates acceptance of the new Terms.
